PRIVACY POLICY AND PERSONAL DATA

Jamie Oliver Food Foundation is committed to protecting and respecting your privacy.

This Privacy Policy (together with our Terms of Use and any other documents referred to in it) sets out the basis on which any personal data we collect from you, receive from third parties or affiliates, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it. For the purpose of the Data Protection Act 1998 (the Data Protection Act), the data controller is Jamie Oliver Food Foundation, a charity registered in England and Wales with charity number 1094536 and whose registered office address is 15 Westland Place, London, N1 7LP (“we”, “us”, and “our”).

  1. In order to provide you with the full range of services on the Site, we will sometimes collect information about you. We will use any personal data collected from the Site in accordance with all laws and regulations of the United Kingdom relating to the protection of personal data including the Data Protection Act (as may be amended). We collect two types of information:  personal data, which is information that identifies you or can be used to identify or contact you (“Personal Data”), and non-personal data, which cannot be used to identify of contact you, such as demographic information (e.g. age or gender), Internet Protocol (IP) addresses, browser types, domain names, and other anonymous statistical data involving the use of our Site (“Non-Personal Data”).Personal Data we collect may include your name, email addresses, postal addresses, postcode/ZIP code, telephone number, credit card information, date of birth, user name, and password, and other information either desirable or necessary to provide quality services to our contributors and visitors. We may also collect Personal Data you provide to us (i) on forms you submit to us; (ii) from personal correspondence, such as emails or letters that you send to us; (iii) if you choose to complete any surveys or questionnaires for us, enter a competition or promotion of ours; and/or (iv) participate in forums, discussion boards or other social media functions on the Site.Non-Personal Data we collect may include: (i) technical information, including the IP address used to connect your computer to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform; and/or (ii) information about your visit, including the full Uniform Resource Locators (URL) clickstream to, through and from our site (including date and time); products you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page and any phone number used to call our customer service number.Lastly, we may receive information about you from third parties, including our business partners, affiliates and other third-party service providers who may collect your Personal Data and Non-Personal Data and share such information with us in accordance with their own privacy policy. Our use of information received from a third party will be dictated by that third party’s privacy policy and not this Privacy Policy.To the extent we are able to do so, we may link your Non-Personal Data with your Personal Data. We may also link information collected online with information we collect offline or that is collected online by third parties including, for example, our business affiliates, subcontractors, advertising networks, analytics providers, and search information providers.“Contribution”, as that term is used in this Privacy Policy, includes all content provided to this Site or uploaded to the Site, e.g. information about activities, videos, clips, photographs, recipes, comments, data posting, competition entries, campaign-related material, and all other user generated material.
  3. We do not store credit card or account details nor do we share contributor details with any third parties, with the sole exception of Paypal account details for local charities for the sole purpose of providing the relevant details for donations directly to them.
  4. Personal Data you are asked to supply during your use of the Site including that which you supply voluntarily and any other information relating to your Contributions (“Your Data”), will be used by us, our affiliates, service providers and other organizations and by subcontractors, employees, agents and advisors (including legal advisors) as follows: (i) in making decisions about whether any Contributions you seek to upload onto the Site should be accepted, rejected or used; (ii) in processing any details you allow us to publish, e.g. your e-mail address in connection with an activity; (iii) to provide you with the information, products and services that you request from us (iv) for sending you our newsletter and other information (as further set out in clause 10 below) where you have agreed to this; and/or (v) as set out on the Site or the Terms or other specific terms appearing on the Site. In addition, we may at our discretion disclose this information to the police, regulatory bodies or any legal advisers in connection with any alleged criminal offence or suspected breach of the Terms of Use by you or otherwise where required by law.Non-Personal Data we collect about you will be used by us, our affiliates, service providers and other organizations and by subcontractors, employees, agents and advisors (including legal advisors) as follows: (i) to administer our Site and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes; (ii) to improve our Site to ensure that content is presented in the most effective manner for you and for your computer; (iii) to allow you to participate in interactive features of our service, when you choose to do so; (iv) as part of our efforts to keep our Site safe and secure; (v) to measure or understand the effectiveness of advertising we serve to you and others, and to deliver relevant advertising to you; and/or (vi) to make suggestions and recommendations to you and other users of our Site about goods or services that may interest you or them.

Except as set out in this Privacy Policy or where we agree otherwise with you (e.g. sending you our newsletter or contacting you in relation to any activities), Your Data will be kept private and confidential, will not be passed on to third parties without your express consent and will be used in accordance with our Privacy Policy.

We may use your Data to contact you by electronic mail (e.g. by email and/or SMS) about events, special offers, promotions and benefits of the Jamie Oliver Food Foundation and affiliated Foundations (“Marketing Communications”), where you have consented to receive such Marketing Communications from us. We may also use third-party social media platforms, including third-party social media websites, to communicate with you. You may receive Marketing Communications from us or a third-party service provider on our behalf. You have the right to ask us not to process your personal data for marketing purposes. We will usually inform you (before collecting your data) if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes. You can exercise your right to prevent such processing by checking certain boxes on the forms we use to collect your data. You may also unsubscribe from Marketing Communications at any time by following the unsubscribe instructions for the particular mode of communication.   10. The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area (“EEA”). Your data may also be processed by staff, service providers, and/or contractors operating outside the EEA who work for us or for one of our suppliers. Such staff maybe engaged in, among other things, the fulfilment of the service, the processing of your payment details, the delivering of promotional materials, the communication of Marketing Communications, the promotion of our social media presence and activities; and/or the provision of support services. By submitting your Personal Data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.
  11. We may share your Personal Data with any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006.We may also share your Personal Data with selected third parties including:
    • The Jamie Oliver Group of companies (which include any body corporate in which Jamie Oliver has a direct or indirect business interest) for the purpose of sending you recipes, news, offers or promotions and other information from the Jamie Oliver Group where you have requested these.
    • Business partners, suppliers and sub-contractors for the performance of any contract we enter into with them or you.
    • Advertisers and advertising networks that require the data to select and serve relevant adverts to you and others. We do not disclose information about identifiable individuals to our advertisers, but we may provide them with aggregate information about our users (for example aggregated demographic and statistical information that is not personally identifiable).
    • Analytics and search engine providers that assist us in the improvement and optimisation of our Site.
  12. We may disclose your Personal Data to third parties:
    • In the event that we sell or buy any business or assets, in which case we may disclose your Personal Data to the prospective seller or buyer of such business or assets.
    • If Jamie Oliver Food Foundation, or substantially all of its assets, are acquired by a third party, in which case Personal Data held by it about its users will be one of the transferred assets.
    • If we are under a duty to disclose or share your Personal Data in order to comply with any legal obligation, or, if, in our reasonable judgment, it is necessary to enforce compliance with our internal policies or the Terms of Use or to protect the Site, our contributors, or others. In connection with a legal action or other proceeding, including without limitation, in response to a court order or a subpoena.
  13. We will hold your Data and for as long as is necessary and reasonably required for the relevant service or purpose. We are committed to protecting the security of any Personal Data you provide to us. We maintain commercially reasonable safeguards to maintain the security and privacy of Personal Data that you provide to us. After you have submitted your information online to us, we recommend that you end your browser session before leaving your computer. Additionally, where we have given you (or where you have chosen) a password which enables you to access certain parts of our Site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone. In spite of these protections, we cannot guarantee the security of any data submitted over the Internet; any transmission is at your own risk.   14. If you are under the age of 18, you must have your parent or guardian’s consent before you provide Personal Data on or to the Site. The Site is a general audience site, and we do not knowingly solicit or collect Personal Data from children under 18 years of age. If you are under 18, please do not use the Site or provide any Personal Data about yourself to us without the permission of your parent or guardian. If we learn that we have collected Personal Data from a child under age 18, we will take reasonable measures to delete that information as quickly as possible and to not use such information for any purpose (except where necessary to protect the safety of the child or others as required by law).
